1. Purpose

These terms govern the relationship between GAPLESS ("the Platform") and any person booking esport coaching services via the Platform ("the Player").

GAPLESS is a marketplace that connects Players with independent coaches ("the Coaches"). GAPLESS is not a party to the service contract concluded between the Coach and the Player: it provides only the connection, booking and payment collection tool, and acts as a trusted third party.

2. Registration and account

  • The Player provides accurate information when registering and keeps it up to date. They are responsible for the confidentiality of their credentials and for any activity carried out from their account.
  • Age: account creation is open to persons aged at least 15 (legal guardian consent required under 15). A minor User's access to paid services is subject to prior validation by their legal guardian, in accordance with the procedure set out in Article 4.3 of the Terms of Use.   • Login may be performed in particular via Discord (OAuth).

3. Booking and payment

  • The Player books a session or a pack at the price freely set by the Coach.
  • Payment is made online via Stripe, an authorized payment services provider. GAPLESS does not store card data and does not hold the funds.
  • The booking is confirmed after the payment is validated. A summary is provided to the Player.

4. Prices and fees

  • The prices of sessions and packs are freely set by the Coaches and shown in euros. VAT is not applicable (art. 293 B of the CGI, basic exemption).
  • A fixed booking fee of 0,50 € is added to every payment, whatever its object: session, pack, purchase of a single video or of a playlist. It is due whatever the Player's subscription, Pro and Elite included, and appears as a separate line before the payment is validated.
  • Premium Player subscriptions are offered: Player Pro (9,99 €/month) and Player Elite (29,99 €/month). The detailed terms of sale are set out in the Terms of Sale.

5. Cancellations and refunds

  • Cancelling a session: the Player may cancel free of charge up to 24 hours before the session (full refund). Between 6 and 24 hours before, 50% of the session price is refunded. Less than 6 hours before, or once the session has started, nothing is refunded. The 0,50 € booking fee is not returned when the Player is the one cancelling. If the Coach does not show up or cancels, whenever that happens, the Player is fully refunded, booking fee included.
  • Coaching packs / subscriptions: the Coach undertakes to provide the services in accordance with the published description of their pack. If the service does not match the description: the parties seek an amicable agreement; failing that, the Player is refunded (in full or pro rata). The Player may cancel the subscription at any time (commitment limited to the current period).
  • Disputes: in the event of a session not delivered, a no-show by the Coach or a service that is manifestly non-compliant, GAPLESS may, after reviewing the evidence, proceed with a full or partial refund.
  • Refunds are made via Stripe to the original payment method.

6. Reviews and reputation

The Player may leave a review after a session. Reviews must be honest and factual. GAPLESS may moderate or remove a review that is manifestly abusive, false or contrary to its rules.

7. Expected behaviour

The Player undertakes to behave respectfully towards the Coaches and refrains in particular from: any hateful, harassing or fraudulent remarks; recording a session without the Coach's agreement; sharing paid content with third parties; any attempt to circumvent the Platform (paying the Coach directly off-platform for a service initiated on GAPLESS in order to avoid the commission). Any breach may result in the suspension of the account.

8. Intellectual property

The GAPLESS brand, the logo, the visual identity, the texts, the code and the visuals of the Platform are protected. The content published by the Coaches (descriptions, videos, programs) remains the property of their authors. The Player remains responsible for the content they publish (profile, messages, reviews) and warrants that they hold the rights to it.

9. Personal data

The processing of the Player's data is described in the GAPLESS Privacy Policy (GDPR). The Player has rights that they may exercise at support@gapless.gg.

10. Liability

GAPLESS provides a connection platform and is not responsible for the intrinsic quality of the services provided by the Coaches, nor for disputes between Player and Coach, beyond its role as a trusted third party and the applicable legal obligations. GAPLESS does not guarantee any sporting result or any particular ranking.

11. Suspension and termination

The Player may delete their account at any time. GAPLESS may suspend or delete an account in the event of fraud, abuse, circumvention, harmful behaviour or breach of these terms.

12. Modification of the terms

GAPLESS may modify these terms. Players are informed of the modifications; continued use constitutes acceptance.

13. Applicable law and disputes

These terms are governed by French law. In the event of a dispute, the parties will seek an amicable solution; failing that, the dispute will be brought before the competent French courts. The consumer may use a consumer mediator free of charge (see Terms of Sale).
